Exurb1a Court Hearing Update: Good News!
I have good news. The first update regarding the Exurb1a rape case you can hear in the above livestream video.
In the livestream video I also discuss the news article published in De Limburger concerning the police failure in the Exurb1a case.
In a nutshell:
I filed a police report against Exurb1a for assault, 2 accounts of rape, blackmail, threats, slander and defamation and stalking.
There are two cases. A Dutch case and a Bulgarian case, because every crime needs to be handled in the country where the crime happened. This makes for a very complex case.
Right now I’m focusing on the Dutch case because in the Netherlands I have a pro-deo lawyer (Richard Korver), who took my case.
My lawyer is not covered for the Bulgarian case. I would need an international lawyer for that case. This costs a lot of money and time. In my area (Limburg), in 2017, 131 rapes were reported. Only 10 lead to a court case. Only 3 rapists were convicted (2.29%). The journalist who wrote about my case investigated this herself and it’s mentioned in the article. Statistics are against me, which is why I can use all the help I can get. 11 people have decided to testify against Exurb1a in the Dutch case and have submitted their witness testimonies to court.
The first shock-witness I spoke to, I called within 24 hours after the first assault/rape to tell him what happened. This shock-witness was not a family member but someone who lived in America I had been friends with online for over 12 years.
Two other shock-witness I spoke to a few days after the first rape.
These 3 shock-witnesses I spoke to a week before Exurb1a and I broke up. So, multiple witnesses already knew about the assault and rape, before Exurb1a and I broke-up due to what happened.
In January 2017, in a recorded cellphone conversation, Exurb1a denied everything that had happened, while at that point 11 shock-witnesses knew already about the situation. Exurb1a claimed I made everything up in January 2017, not knowing I had already told 11 people at this point what had happened.
The Dutch court case was handled behind closed doors, on September 25, 2018.
This is a violation of human rights (article 10). Everyone is entitled to a public hearing of their court case. I was denied a public hearing. Why? My guess would be to protect the rapist and the Dutch police. Journalists were not allowed inside the court either.
The court case in the Netherlands concerned not just my case against Exurb1a, but also concerned the police failure in it. This is probably the reason why the case was forced behind closed doors.
The Dutch court case was a very specific case against the Dutch police too, called an ‘article 12 procedure‘. Usually these procedures are handled very quickly, behind closed doors. This is an element of a fascist system: police failure addressed inside a court room, where witnesses aren’t allowed present.
Second court dates in these article 12 procedures are almost never given. Usually you get one chance to make your case. You’re not allowed to appeal the outcome, that’s forced behind closed doors.
I was given a second court hearing however, which like I said, apparently almost never happens.
The fact that my lawyer and I were given a second court date, is great news, since this almost never happens in these procedures. If court didn’t think we could prove our case against the police and Exurb1a, they wouldn’t have done this.
My second court date is on December 18, 2018.
